JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sono P.S. Case No. 183 of 2016, registered under Sections 188, 420, 409 of the Indian Penal Code.

The accusation is that the petitioner being secretary of the Panchayat of Lakhan Kiyari and Belamba on transfer did not hand over the charge to Awadhesh Kumar Singh posted in his place. Petitioner also withdrew Rs. 30,37,200/- for distributing the same to the beneficiaries of Indira Gandhi National Old age Pension Scheme.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.27380 of 2017 (3) dt.22-08-2017 petitioner handed over the charge of the Panchayat Secretary of the Lakhankiyari and Belamba to Sri Awadhesh Kumar Singh, Panchayat Secretary, which has come in paragraph Nos. 7 and 9 of the case diary. The petitioner has also disbursed Rs.30,32,800/- to the beneficiaries of Indira Gandhi National Old age Pension Scheme and remaining amount of Rs. 4,400/- has already been deposited in the Nazarat of Sono on 25.04.2017. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jamui, in connection with Sono P.S.
