The petitioner is in custody since 06.09.2018 in connection with Prosecution Case No. CI-528 of 2018 for the offence registered under Sections 30(a) read with Section 13 of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that entire case is false and fabricated and there has been no recovery from his possession.
Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the
Patna High Court Cr.Misc. No.78389 of 2018(2) dt.28-01-2019 2/2 like amount each to the satisfaction of Additional District and Sessions Judge IInd-cum-Special Judge, Katihar in connection with CI Case No. 528 of 2018.
