The petitioner has prayed for anticipatory bail apprehending his arrest in connection with Lalganj P.S. Case No. 63 of 2013 arising from Complaint Case No. 2431 of 2012 which stood translated in police case under Section 156(3) of the Code of Criminal Procedure and registered for the offences punishable under Sections 298(A), 313, 406, 406,307/34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.
The petitioner happens to be the husband and it is in consideration of the nature of allegations that notice was issued to the complainant who though served has not chosen to appear. The
Patna High Court Cr.Misc. No.9933 of 2014 (7) dt.02-03-2016 2/2 petitioner was granted provisional bail by this Court vide order dated 19.4.2014.
In the nature of allegations so discussed and considering that the opposite party No.2 though served has not chosen to contest the prayer as well taking note of the submission of learned counsel for the petitioner relying upon a compromise petition placed at Anneuxre-2, the provisional bail granted to the petitioner on 19.4.2014 is hereby confirmed.
The application is accordingly allowed.
