Petitioner seeks regular bail in connection with Khodawandpur P.S. Case No. 40 of 2021 registered for the offence under Section 411 , 414 , 465 , 477 / 34 of the I.P.C. The allegation as per the First Information Report is that three persons riding on a black colour Apache motorcycle were intercepted by the Police and upon enquiry it was found that the motorcycle in question was stolen one for which Hathidah P.S. Case No. 03 of 2021 was lodged. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and after arrest of the petitioner in the present case he has been
Patna High Court CR. MISC. No.32635 of 2021(3) dt.22-12-2021 2/3 remanded in Hathidah P.S. Case No. 03 of 2021. Learned counsel next submits that three persons were arrested by Police and petitioner was not driving the motorcycle in question and he was not aware about the fact that the same was stolen property and the petitioner is in custody since 11-02-2021. Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner is in custody since 11-02-2021, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs.
20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Manjhaul, Begusarai in connection with Khodawandpur P.S. Case No.
