ANJANA MISHRA ORAL ORDER 18-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 457/380 of the Indian Penal Code.
Learned counsel for the petitioners submits that only and because of the fact that there was a dispute with regard to theft of hen from the front of the house of the informant, the present case regarding theft of articles from Kirana Shop has been made by the informant. He further submits that the seizure report is also an imaginary document and it is unbelievable that small amount of recoveries made, are purely household items and can be present in domestic household would be treated as a part of recoveries of articles stolen from the Kirana Shop.

No.27456 of 2017 (2) dt.18-07-2017 P2/2 Considering the vague nature of allegations made and also because the First Information Report so lodged has been placed before the concerned Court after three days of occurrence and the lodging of First Information Report, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-II, Jamui in connection with Chandramandih P.S. Case No. 122/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
