Petitioner seeks regular bail in connection with Turkauliya (Raghunathpur) PS Case No. 159/2020 registered for the offence punishable under Sections 30(a) of Bihar Prohibition & Excise Act.

As per First Information Report, the police on the basis of secret information proceeded towards the place of occurrence and upon seeing the police party four-five accused persons including petitioner succeeded in fleeing away. The name of petitioner and others came on the basis of secret

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of secret information received by the police and no illicit liquor has been recovered from the conscious possession of the petitioner or from his vehicle. Referring to para-9 of this petition, learned counsel next submits that the Bolero vehicle, from where illicit liquor has been recovered, does not belong to him. Petitioner is in custody since 08.01.2021 and the charge-sheet has been submitted in the matter.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is not the owner of the vehicle from where illicit liquor has been recovered, he is in custody since 08.01.2021 and the charge-sheet has been submitted in the matter, I am inclined to grant regular bail to the petitioner subject to the condition that petitioner will be well represented on each and every date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled. Accordingly, let the petitioner, BHUAR SAHANI @ ANGAD SAHANI @ ANGAD CHAUDHARY be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)
