Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Session Trial No. 230 of 2021 arising out of Salkhua P.S. Case No. 87 of 2021 lodged under Sections 341, 323, 326, 302, 506/34 of Indian Penal Code.

As per the prosecution case, informant has seen from his own eyes that present petitioner along with two others has attacked with Dabiya (Gadasa) continuously on the head of her husband upon which he became badly injured and died on the way to the hospital.

Learned counsel for the petitioner submits that petitioner is quite innocent and has falsely been implicated in

Patna High Court CR. MISC. No.24423 of 2022(2) dt.17-08-2022 2/2 this case. He further submits that petitioner is in custody since 23.05.2022.

Learned counsel for the State opposes the prayer for bail and states that there is direct allegation upon the present petitioner to attack on the husband of the informant which resulted into his death.

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the present petitioner, therefore, his bail application is hereby rejected.

With this observation, the bail application stands rejected.
