ANJANA MISHRA ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 28-06-2019 Heard learned counsel for the applicant and perused the records. There are certain objections pointed out by the office which are ignored. This is a dispute about compassionate appointment.

We have considered the submissions raised and we find that there is an objective assessment made in the communication dated 29th of January, 2016 which in detail indicates the award of points to the petitioner. After having awarded the points, the authority has also informed the petitioner that the 11 posts which were identified for being filled up by compassionate appointment

Patna High Court CWJC No.12914 of 2019 dt.28-06-2019 2/2 had to be offered on the basis of a 60 merit point calculation. The petitioner scored only 41 points to his credit. A challenge raised to the same before the Tribunal has failed and the Tribunal has also recorded that even if a few more points are awarded in favour of the petitioner, yet he would not be able to reach the bench mark fixed by the authorities.

There is no other material on record so as to counter the aforesaid findings recorded except for the allegations that the calculation is incorrect. We are unable to subscribe to the said submission raised on behalf of the petitioner, more so keeping in view the fact that family pension is being paid to the mother of the petitioner to the tune of Rs.21,000/- approximately.

The petition is, accordingly, dismissed.
