JUSTICE SHIVAJI PANDEY ORAL ORDER 16-01-2019 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. In this case, the petitioner is seeking anticipatory bail in connection with Andhratharhi P.S. Case No. 105 of 2018 (G.R. No.1237 of 2018), registered for the offence under Sections 447, 341, 323, 324, 354(B), 504 and 506/34 of the Indian Penal Code.

Allegation has been made that when the informant had gone to the hand-pump to fetch water, she was surrounded by the petitioner and others and tried to put the drug through a Syringe on the body of the informant, when she raised alarm they fled away from there, but later on, they again came and assaulted the family members by lathi and danda. Learned counsel for the petitioner submits that no injury has been sustained by any of the family members nor

Patna High Court Cr.Misc. No.964 of 2019(2) dt.16-01-2019 2/2 there is any allegation that the petitioner was ever tried to disrobe the victim, but wrongly the petitioner has been implicated in this case.

Whereas, learned counsel for the informant has produced the photocopy of the seizure list, from where it appears that broken glass, wherein it has been recorded Sterwin 1 ml. and a Syringe have been recovered.

On perusal of the F.I.R. it appears that there is no allegation of disrobing the victim in any manner. Looking to the aforesaid facts and circumstances of the case, let the petitioner, namely, Pawan Jeet Ram, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M., 1st, Jhanjharpur, Madhubani, in connection with Andhratharhi P.S. Case no. 105 of 2018 (G.R. No.1237 of 2018), subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) pawan/- U T
