The petitioners apprehend their arrest in Nathnagar P.S. Case No. 129 of 2016, registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.

The informant alleged that Kundan Mandal, Pugeshwar @ Pugia Mandal, Bishundeo Mandal, petitioner no. 1, Amarnath Mandal, petitioner no. 2 and Ranjit Mandal kidnapped his daughter.

Learned counsel for the petitioners submits that petitioners are innocent and they have in fact committed no offence. The victim made her statement under Section 164 of the

Patna High Court Cr.Misc. No.30337 of 2016 (2) dt.14-09-2016 2/2 Cr.P.C. and she disclosed that Kundan Mandal kidnapped her and confined her in the house of Sunil Mandal. After one hour she was confined in one Anganbari Seva Kendra from where Pugeshwar Mandal released her and she came to the house of her parents. It is submitted that the victim did not disclose the name of the petitioners as her kidnappers.

Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar P.S. Case No. 129 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
