JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-01-2019 The petitioner, who is a Panchayat Secretary, seeks bail in anticipation of his arrest in connection with Vijaypur P.S. Case No. 149 of 2016 dated 14.09.2016 instituted for the offences under Sections 420, 409, 34 of the Indian Penal Code.

The petitioner is alleged to have not deposited the records with respect to appointment of teachers in the Panchayat.

The learned counsel for the petitioner on instructions refutes the aforesaid allegation and submits that way back in the year 2016, all the documents were furnished by the petitioner. In support of the aforesaid

Patna High Court Cr.Misc. No.354 of 2019(2) dt.29-01-2019 2/2 contention, a receipt of the aforesaid documents also has been brought on record by way of Annexure-2.

Regard being had to the aforesaid facts, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Vijaypur P.S. Case No. 149 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Shageer/- U T
