2. The petitioner has preferred this application for grant of regular bail in connection with Fesar P.S. Case No. 113 of 2024 dated 13.10.2024 registered for the offences punishable u/ss 191(2), 191(3), 190, 126(2), 115(2), 352, 351(2), 74, 324(2), 303(2) and 109 of the Bharatiya Nyaya Sanhita.
3. As per the prosecution case, on 12.10.2024, the informant went to see the fair with his family, in the meantime, some boys of his village started teasing his sister, a scuffle took place and he returned his home. On 13.10.2024, the informant

No.25513 of 2025(2) dt.05-05-2025 2/3 opened his door then he saw that the petitioner and the coaccused persons along with 8-10 unknown accused persons have confined his house and they were armed with lathi, danda, sharp cutting weapons and arms. Thereafter, the accused persons have forcibly entered inside his house and assaulted on his head, back, hand and legs with lathi as a result of which he fell down. It is further alleged that the accused persons assaulted his brother Abhay Kumar mercilessly. The accused persons have flashed gun and snatched ornaments of his mother, sister and wife worth Rs. 10 lakhs and Rs. 10 lakhs in cash kept for marriage of his sister. It is further stated that the accused persons have assaulted the informant's brother Pappu Kumar with the butt of gun on his leg due to which he sustained cut injury on his left leg. It is further alleged that the accused persons have looted documents of his house and damaged his vehicles parked in front of his house. The miscreants have threatened to set ablaze the informant's house.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. It is further submitted that there is case and counter case between the parties. Nothing has been recovered from the
Patna High Court CR. MISC. No.25513 of 2025(2) dt.05-05-2025 3/3 conscious possession of the petitioner. As per the injury report of the injured, the injuries are simple in nature caused by hard and blunt object. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 21.02.2025.
5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Aurangabad in connection with Fesar P.S. Case No. 113 of 2024.
7. The application stands allowed.
