JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner as well as learned counsel for the State.
In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 379 and 420 of the I.P.C. and section 10 of Bihar Pariksha Sanchalan Adhiniyam.
The allegation against the petitioner is that he fled away with the answer sheet of physics paper from the centre of L.S. College, Muzaffarpur.
Submission is of false implication and that the petitioner has obtained 45 marks in theory physics paper and 28 marks in practical and he has passed intermediate examination in 2016 having Roll No. 10074 in first division which is evident from
Patna High Court Cr.Misc. No.33596 of 2016 (2) dt.20-08-2016 2/2 the marks statement and also from the provisional certificate issued by the Bihar School Examination Board, further his character has been found good as is evident from the college leaving certificate which are annexed with this bail application. The learned A.P.P. after going through these papers fairly submits that the petitioner has obtained 45 marks in physics theory paper and as such it reveals that the FIR lodged under misinformation. In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within one month from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Muzaffarpur in University P.S. Case No. 15 of 2016, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
