JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-01-2022 Heard Mr. Viveka Nand Singh, learned counsel for the petitioner and Mr. Nawal Kishore Prasad, learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner seeks regular bail in connection with Maheshkhunt P.S. Case No. 76 of 2020 registered for the offence punishable under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code 1860.
The allegation is that the petitioner obtained employment in the Electric Supply Division, Gogri, as an electrician on the basis of forged certificate issued by the I.T.I, Digha.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.35079 of 2021(2) dt.04-01-2022 2/3 petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case with oblique motive. He further submits that a departmental proceedings has also been initiated against the petitioner. He next submits that a person having similar allegation who submitted forged certificate issued from the ITI Digha in the same Electricity Division, has been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 6.1.2021 passed in Cr. Misc. No. 30112 of 2020. The petitioner is in custody since 11.2.2021.
Regards being had to the submission made by the parties and taking into consideration the nature of allegation, the fact that the petitioner is in custody since 11.2.2021, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of Smt. Ankita Jaisawal,
Patna High Court CR. MISC. No.35079 of 2021(2) dt.04-01-2022 3/3 learned Judicial Magistrate, 1st Class, Khagaria, in connection with Maheshkhunt P.S. Case No. 76 of 2020. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
