1. Heard learned counsel for the petitioner and learned Special P.P. for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 74,126(2),115(2) of Bharatiya Nyaya Sanhita, Sections 8,12 of the Protection of Children From Sexual Offences Act and Sections 3(1)(r)(s),3(1)(w),3(2)(va) of the SC/ST Act.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a young boy aged about 25 years and the informant alleges that a minor daughter had gone to a shop for purchasing pen, when petitioner intercepted her and started teasing her, on which local people gathered when petitioner fled after abusing her by her caste name.

4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that a specific pleading has been made at Para-5 of the anticipatory bail application that petitioner and the informant are neighbour and they are having dispute relating to balcony. It is also submitted that it does not appear probable in a market place the petitioner would have teased the victim who is known to her and is her neighbour. It is further submitted that though there is an allegation that petitioner fled after abusing her by taking caste, but then, the abuse is not disclosed in the FIR. It is also submitted that from perusal of the FIR, it would manifest that the same has been instituted on 22.11.2024 when the date of occurrence is 08.11.2024, which further cast an aspersion on the case of the prosecution.
5. Learned Special P. P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees

No.23436 of 2025(2) dt.30-04-2025 3/3 Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-VI-cum-Special Judge POCSO, Patna in connection with SC/ST P. S. Case No.68 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C. with a further condition that one of the bailors of the petitioner shall be his father namely Birendra Kumar Sinha.
7. The application stands allowed.
