The very object and purpose of providing compassionate appointment is to provide relief to the family immediately due to death of the employee. Thirteen years have gone past since the death of the employee. In addition to that, it is evident that the case of the present petitioner was considered by the
Patna High Court CWJC No.7939 of 2017 dt.08-08-2017 authorities and since there is a weightage system which is applied for such cases by settled parameters and the marks which is awarded in terms of the scheme, his number of marks did not add up to the minimum required 55 points, he secured 16 points initially only.
Since the object of the compassionate appointment has been lost in the last 13 years, this Court is not willing to interfere with the order of the Tribunal by trying to find employment to an otherwise unemployable or may be unemployed member of the family especially when his case was considered and not found fit.
The writ application is dismissed.
