The petitioners apprehend their arrest in Desari P.S. case No. 259 of 2018 registered under Section 302/201/34 of the Indian Penal Code.
The informant, father of the deceased, alleged that his daughter was married to Baiju Paswan, S/o Late Kishuni Paswan, in the year 2004 but his son-in-law developed illicit relation with another woman and for that he started subjecting his daughter to physical and mental torture. The informant got information about the death of this daughter and when he went there the husband and other in-laws of his daughter were found absconding from their house.
The learned counsel for the petitioners submits that petitioners are brother-in-law, mother-in-law and married sister-
Patna High Court Cr.Misc. No.80144 of 2018(2) dt.16-01-2019 2/2 in-law (Nanad) of the deceased. The marriage was solemnized in the year 2004. The petitioners were living separately and they have no manner of concern with the family affairs of the deceased and her husband.
Taking into consideration the fact that the marriage was solemnized in the year 2004, the deceased died in the house of her husband after 14 years of marriage and petitioners are brother-in-law, mother-in-law and married sister-in-law (Nanad) of the deceased, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Vaishali at Hajipur in connection with Desari P.S. Case No. 259 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
