This application is filed for grant of regular bail in connection with NDPS Case No. 21 of 2021 arising out of Amba P.S. Case No. 198 of 2021 registered under section8/20(b)(ii)(B)/25 of Narcotic Durg and Pshycotorphic Substance Act.
Learned counsel for the petitioner submits that there is recovery of intermittent quantity (5kg) and also the petitioner is in custody since 21.11.2021. He further submits that similarly situated accused one Ranjan Kumar Gupta has granted bail in Criminal Miscellaneous No. 35501 of 2022 vide order dated
Patna High Court CR. MISC. No.23938 of 2023(2) dt.17-05-2023 2/2 28.09.2022.
Learned A.P.P. has vehemently opposed the prayer for bail.
In view of the submissions made by the learned counsel for the petitioner, this application for regular bail is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge NDPS cum Additional Session Judge-1st, Aurangabad in connection with NDPS Case No. 21 of 2021 arising out of Amba P.S. Case No. 198 of 2021 The petitioner is directed to cooperate in the trial. If the petitioner does not cooperate in the trail, the Court below is at liberty to cancel the bail bonds of the petitioner.
