JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code. Petitioner is not named in the first information report and from perusal of paragraph 31 of the case diary, it appears that the name of the petitioner came in confessional statement of co-accused Raghuwar Sah. Moreover, except the aforesaid confessional statement as well as some criminal antecedent of the petitioner, there is nothing against him. Learned counsel appearing for the petitioner submits that having more or less similar allegation some coaccused have already been granted privilege of bail by different

No.1611 of 2019(3) dt.15-03-2019 2/2 benches of this court whereas petitioner is in jail custody since 20.03.2018 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Sikarpur P.S. Case No. 497 of 2017.
