Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 9, 10 and 11 of Prohibition of Child Marriage Act and Section 75 of the Juvenile Justice Act, registered in connection with Belsand P.S.Case No. 183 of 2019. As per allegation, the marriage of minor girl Babita Kumari was solemnized with Pappu Kumar. The allegation against the petitioner is that he facilitated the marriage and thus violated the provisions of Prohibition of Child Marriage Act. The learned counsel for the petitioner has submitted that the petitioner has no role in the alleged marriage and he is a person of clean antecedents. It is submitted further that the husband of the minor girl Pappu Kumar has been granted

Patna High Court CR. MISC. No.32649 of 2021(2) dt.04-04-2022 2/2 anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No.39917 of 2020.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Belsand P.S.Case No. 183 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
