The petitioner being the mother of the husband of the complainant is apprehending her arrest in a complaint case wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 498A of the Indian Penal Code and 4 of Dowry Prohibition Act.
The basic accusation is of torture for nonfulfillment of the dowry demand. It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.53108 of 2015 (2) dt.24-11-2015 2/2 petitioner that the thrust of accusation is against the husband of the complainant and there is omnibus and general accusation against this petitioner.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Complaint Case No. 170 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
