JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Nadi P.S. Case No. 242 of 2018 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 26.11.2018. He submits that in the instant case total 36 litres liquor was seized. He further submits that the said liquor was not recovered from the possession of the petitioner. He submits that the petitioner was a passenger of the Boat from which the said liquor was recovered and he has no knowledge about the aforesaid wine.

Considering the fact that the petitioner has got no criminal antecedent and he is in custody since 26.11.2018, the

Patna High Court Cr.Misc. No.1949 of 2019(2) dt.15-01-2019 2/2 petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in connection with Nadi P.S. Case No. 242 of 2018.
