The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

1245.60 liters of foreign liquor has been recovered from the pick-up van and the driver, who was apprehended on the spot, disclosed the name of the petitioner. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the said pick-up van and has got clean antecedent.

Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the

No.24827 of 2022(2) dt.05-08-2022 2/2 event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District & Sessions Judge um Special Excise Court no. 2, Katihar / concerned court in connection with Balrampur P.S. Case No. 160 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J) anay/- U T
