Petitioner seeks bail in NDPS Case No. 4 of 2018 registered for the offence punishable under Section20(b) of the NDPS Act.

Allegation is of recovery of 40 Kg of Ganja from the dickey of the Maruti Suzuki SX4 vehicle in which petitioner was travelling.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case on suspicion. Petitioner is neither the owner nor the driver of the vehicle. It has been further submitted that the petitioner was not aware that Ganja has been kept in the vehicle in question. Petitioner has got no criminal antecedent and is in custody since

Considering the aforesaid facts and circumstances of the case and the fact that 40 Kg of Ganja has been recovered from the possession of the petitioner, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.

However, the trial court is directed to expedite the trial and conclude the same within a period of one year. (S. Kumar, J) ranjan/- U
