The petitioner seeks bail in connection with Dagarua P.S. Case No. 418 of 2023 instituted for the offence under Sections 420, 406, 467, 468, 471 & 34 of the Indian Penal Code.

Prosecution case in short is that accused persons including the petitioner have hatched conspiracy against the petitioner on the pretext of doubling the money and cheated an amount to the tune of Rs. 20 lakhs.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 09-12-2023. Petitioner is a man of clean antecedent.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. It is submitted that there is delay in lodging of the FIR. It is submitted that as far as recovery of Rs. 50,000/- from the house of the petitioner is concerned, the same was withdrawn by his wife from SBI on 05-12-2023 and 06-12-2023. It is also submitted that dispute involved in the present case is purely civil in nature. It is lastly submitted that charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.
Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Dagarua P.S. Case No. 418 of 2023.
