JUSTICE RAVI RANJAN ORAL ORDER 29-08-2016 I have heard learned counsel for the petitioners and the State.
The petitioners apprehend their arrest in a case registered for offences punishable under Sections 147, 148, 149, 188, 341, 323, 337, 338, 353, 307, 427 and 285 of the Indian Penal Code. As per the allegation, there was altercation between persons forming two processions one of which was for the purpose of emersion of idol of Goddess Durga whereas another was a Mahaviri procession, causing injury upon Vijay Kumar Singh who had subsequently died for which another case under Section 302 and other allied sections of the I.P.C. was lodged by a
Patna High Court Cr.Misc. No.29598 of 2016 (2) dt.29-08-2016 2 / 2 private person being Revealganj P.S. Case No. 191 of 2015. It is contended that there is no specific allegation against the petitioner and in the aforesaid case, a co-ordinate Bench of this Court vide Annexure 3 has already granted privilege of anticipatory bail. Having regard to the facts and circumstances of the case, let the petitioners, namely, Shiv Sah and Salti Kumar @ Salti Kumar Singh be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Revelganj P.S. Case No. 192 of 2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Chapra, District, Saran subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
