From Annexure 7 of the writ petition, it appears that Respondent No 3 has asked the petitioner to submit his defence in respect of Report dated 15.02.2020, by enclosing a copy of the same, in connection with the departmental proceedings conducted against him. It is the petitioner's case that he has submitted his response to Respondent No 3 (Annexure 8 dated 26.02.2020). However, no action has been taken thereupon. Since the matter is pending before Respondent No 3,

Patna High Court CWJC No.9281 of 2020(3) dt.01-07-2022 2/2 as per submission of the petitioner's counsel, the Court is not called upon to adjudicate the issue.

From perusal of Annexure 8 and having regard to the vague receiving inscribed on the same, this Court would consider it appropriate to direct the petitioner to submit his response to Annexure 7 afresh before Respondent No 3. If no decision has been taken yet thereupon, Respondent No 3 should consider the same and pass appropriate orders thereupon in accordance with law.

Writ petition stands disposed of.
