For the Petitioner/s : Mr. Deepak Kumar Singh For the Opposite Party/s : . Smt. Meena Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 26-08-2016 Heard learned counsel for the parties.
This application for grant of anticipatory bail arises out of Tajpur P.S. Case No. 18 of 2016, disclosing offences under Sections 366,366A/372/34 of the Indian Penal Code. Considering the fact that there is specific allegation against co-accused Rahul Kumar and this petitioner of kidnapping the informant's daughter, I am not inclined to grant the petitioner privilege of anticipatory bail since his custodial interrogation may be required. I have taken note of the fact that the girl has so far not been traced.
This application is, accordingly, rejected.
The petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so
advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail. (Chakradhari Sharan Singh, J) ArunKumar/- U
