JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 Earlier the prayer for bail of the petitioner was rejected vide order dated 12.10.2018 passed in Cr. Misc. No. 58384 of 2018 with a direction that he may renew his prayer for bail after six months or after framing of charge, whichever is earlier.

The petitioner seeks regular bail in connection with Narpatganj P.S. Case No. 46 of 2018, G.R. No. 256 of 2018, registered for the offences punishable under Section 392 of the Indian Penal Code.

Allegation against the petitioner is of committing loot of bank cash van.

Submission of learned counsel for the petitioner is that except confessional statement there is absolutely nothing against him and he is in judicial custody since 25.06.2018.

Having heard both sides, considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Narpatganj P.S. Case No. 46 of 2018, G.R. No. 256 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
