This is an application seeking quashing of the FIR of Farbishganj P.S. Case No. 242 of 2016 dated 26.05.2016 instituted for the offence under Sections 406, 420 and 120(B) of the Indian Penal Code. A report had been called for from the court below about the stage of the case. The report has since been received. It appears that the accused persons are still absent and therefore for securing their attendance summons have been issued. The next date in the case was fixed on 23.11.2020.
This case relates to the defaulter rice millers and the records have been transferred to the concerned court only on 28.04.2018.
Patna High Court CR. MISC. No.35587 of 2016(5) dt.06-01-2021 2/2 Learned counsel for the petitioner, however, has stated that all that was required to be deposited by the petitioner has already been deposited.
These factual aspects shall be gone into the by the trial court and necessary orders shall be passed without any delay.
This Court at present is not inclined to quash the FIR.
This petition is dismissed with the aforesaid observation.
