The petitioner seeks regular bail in connection with Phuwlari P.S.Case NO.752 of 2018 registered for offences punishable under Sections 4, 5 and 6 of the Explosive Substances Act..

There is recovery of one bomb from the co-accused Wakar Ashar and he has named this petitioner also. Submission of the learned counsel for the petitioner is that there is no recovery from the possession of the petitioner and he is in custody since 16.1.2019. He has no criminal antecedent and co-accused Wakar Ashar has been granted bail by a Co-ordinate Bench of this Court, vide order dated 6.2.2019 passed in Cr.Misc. No.1440 of 2019.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II, Patna in connection with Phulwarisharif P.S.Case No.752 of 2018. With the above direction, this application is allowed.
