The petitioner apprehends his arrest in Suryagarha (Manikpur) P.S. Case No. 75/2014, registered for the offences punishable under Sections 302, 201, 120B of the Indian Penal Code.
The petitioner is not named in the FIR. The informant, father of the deceased lodged a case after recovery of dead body on 30.03.2014. The informant alleged that his son Gaurav Kumar went to see the electric wire which was burning but did not return. After more than one month on 3rd May, 2014, the informant made his statement under Section 164 of the Cr.P.C. and disclosed that his son was in his house. Soni Kumar, Ravi Kumar and Monu Kumar took his son, but his son did not return. The informant
Patna High Court Cr.Misc. No.30605 of 2015 (4) dt.07-10-2015 2/2 claimed that Soni, Lallu, Ravi Kumar, Disco and Bholu must have killed his son, as his son had love affair with one Rakhi. The wife of the informant and others also made their statement under Section 164, but they altogether gave a different story of the occurrence.
It is submitted that except the suspicion, there is no material.
Learned Additional P.P. did not dispute this fact. Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Suryagarha (Manikpur) P.S. Case No. 75/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
