The petitioner being the husband of the complainant is apprehending his arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under sections 498A of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the complainant. The complainant got married with one Pintu Kumar. Thereafter the petitioner filed Complaint Case No. 895/2014 against the complainant and Pintu Kumar wherein process has been directed

Patna High Court Cr.Misc. No.30164 of 2016 (2) dt.22-07-2016 to be issued and cognizance has been taken under section 494, 497, 498, 323, 380, 493, 307 and 504 of the Indian Penal Code and thereafter the present complaint case being Complaint Case No. 909/2014 has been registered.

Considering the nature of accusation and the complaint case being filed by the petitioner at the earlier point of time, let the abovenamed petitioner be released on anticipatory bail, in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Jehanabad in Complaint Case No. 909/2014, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
