The petitioner apprehends his arrest in a case registered for offences punishable under Section 341, 342, 323, 307, 353, 504/34 of the Indian Penal Code.

As per allegation the petitioner along with five others had came and started abusing the informant, who happens to be the Circle Officer, and co-accused Suleman and Ajeej started assaulting him by lathi. It is contended that from the First Information Report it is apparent that specific allegation of assault is upon co-accused Suleman and Ajeej. So far as the petitioner is concerned, there is no allegation except general and omnibus allegation that the petitioner was also there and abusing

It is urged that there is no injury upon the informant though there is allegation of assault by coaccused Suleman and Ajeej. Having regard to the facts and circumstances of the case, let the petitioner, namely, Israfil @ Md. Israfil @ Israfil Meer be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Jalalgarh P.S. Case No. 14 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sub Judge IV-cum-Addl. Chief Judicial Magistrate, Purnea subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure. (Dr. Ravi Ranjan, J) Spd/- U T
