Mr.Dr. Indiwar Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-04-2019 Application with regard to petitioner no.2 (Mukesh Rai @ Mukesh Kumar) has already been dismissed as withdrawn,vide order dated 16.01.2019.

So far nos.1 and 3 are concerned, they are apprehending their arrest in connection with Hajipur Sadar P.S.Case No.506 of 2017 date 10.10.2017, registered for offences punishable under Sections 341, 447, 323, 307, 379, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioners is of firing on the informant and others causing injury and further it is submitted that the injuries are of fire arms.

Submission of the learned counsel for the petitioners is

Patna High Court CR. MISC. No.77115 of 2018(3) dt.12-04-2019 2/2 that the injuries are simple in nature and about some injuries, the opinion was kept reserved and further there is case and counter case. Both the parties have received injuries. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court and if possible to be disposed of on the same day With the aforesaid observation, this application is dismissed.
