In this application for anticipatory bail the petitioner apprehends his arrest in connection with Mahua P.S. Case No. 11 of 2017 for the offences punishable under sections 307, 324 and 302/34 of the I.P.C. and section 27 of the Arms Act. Allegation against the petitioner is that the petitioner and Gonour Singh assaulted Sanjay Kumar with farsa and sword on his head resulting Sanjay Kumar fell down. Submission is of false implication and that the injury report of Sanjay Kumar is mentioned in paragraph-51 of the case diary, only one lacerated wound over head right parietal region has been found on the person of Sanjay Kumar, co-accused Manoj

Patna High Court Cr.Misc. No.30816 of 2017 (3) dt.21-08-2017 2/2 Kumar Singh has been allowed pre-arrest bail by another coordinate Bench of this Court and as such the petitioner deserves sympathetic consideration.

The learned A.P.P. opposes the prayer for pre-arrest bail of the petitioner by submitting that on the person of Sanjay Kumar injury has been found on the head and the petitioner has assaulted with farsa so lacerated wound is possible. In the facts and circumstances stated above, considering the allegation, I am not inclined to grant privilege of pre-arrest bail to the petitioner and accordingly his such prayer stands rejected in connection with the aforementioned case pending in the court of C.J.M.
