Petitioner apprehends his arrest in Sono P.S. Case No.274 of 2018 registered under Sections 272 and 273 of the Indian Penal Code as well as under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016.
The informant alleged that on secret information that huge quantity of liquor was being carried in the vehicle, the police followed Bolero vehicle bearing Registration No.BR09F 0209. The driver of the vehicle was arrested on chase and driver of the vehicle disclosed that the petitioner being the owner of the vehicle managed to flee away.
Learned counsel for the petitioner submits that petitioner was not present in the vehicle. The driver of the vehicle falsely implicated the petitioner but it appears that the
Patna High Court Cr.Misc. No.80102 of 2018(2) dt.15-01-2019 2/2 police caught the driver of the vehicle on chase who disclosed that another person managed to flee away. The driver after being arrested on the spot named the petitioner. Huge quantity of different brands of Indian made foreign liquor kept in 648 bottles was recovered from the vehicle.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Jha, J) S.KUMAR/- U T
