JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-04-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Sarai P.S. Case No. 09 of 2019 for the offence under Sections 414/34 of the Indian Penal Code and Sections 30(a) and 32(2), 35(a),38(1) and 41(1) of the Bihar Prohibition and Excise Act, 2018.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 10.01.2019. He further submits that in the instant case total3740.4 litres of liquor was seized. He also submits that the petitioner is the driver of the vehicle. Learned counsel submits that the petitioner is neither the owner of the vehicle nor the owner of the seized liquor.
