Mr.Sri Sanjay Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 At the very outset submission of the learned counsel for the petitioner is that petitioner no.1 (Madan Rajak) has been arrested.
As such this application against the petitioner no.1 is dismissed as withdrawn as it has become infructuous. So far petitioner no.2 and 3 are concerned, they are apprehending their arrest in connection with Barun P.S.Case nO.97 of 2018 , registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 395, 436, 504, 120B of the Indian Penal Code and Section 3⁄4 of Prevention of Damage of Public Property Act.
Allegation as per IR is that due to accident a mob assembled and damaged the public property and also created
Patna High Court Cr.Misc. No.1579 of 2019(2) dt.23-01-2019 2/2 road blockade.
Submission of the learned counsel for the petitioners is that they are not named in the FIR and no specific allegation has been attributed against them.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Barun P.S.Case nO.97 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case. With the aforesaid observation, this application is allowed.
