1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Complaint Case No. 882 of 2023 dated 10.05.2023 registered for the offence punishable under Sections 504, 323, 379, 498A of the I.P.C. and Section 3⁄4 of the D.P.Act.

3. The petitioner is the husband of the complainant. His marriage was solemnized with the complainant -opposite party no. 2 on 07.12.2021. The petitioner allegedly subjected the complainant to mental and physical torture for want of dowry of Rs. 7,00,000/- and a Bullet motorcycle.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further

Patna High Court CR. MISC. No.23952 of 2025(5) dt.20-02-2026 2/3 submits that since the petitioner is a labourer so the parents of the complainant wants to marry their daughter with another man. He also submits that the petitioner or his family members never demanded any dowry from the complainant. The petitioner had earlier filed Matrimonial Case No. 21 of 2023 under Section 9 of the Hindu Marriage Act for restitution of conjugal right on 17.04.2023 before Principal Judge, Family Court, Madhepura in which judgment was passed on 18.05.2024 in favour of the petitioner.

Learned counsel next submits that the case was sent for mediation by this Court vide order dated 19.11.2025 and in the mediation between the husband and wife the case has been compromised and final mediation report has been prepared and signed by both petitioner and the opposite party no. 2 on 22.12.2025.

6. Learned counsel for opposite party no. 2 supports the argument of learned counsel for the petitioner regarding amicable settlement arrived at between the parties through the process of mediation.

7. Considering the fact that the matter has been compromised between husband and wife and mediation report has been submitted by the learned Mediator having the terms and conditions

No.23952 of 2025(5) dt.20-02-2026 3/3 of compromise, I am inclined to grant the petitioner privilege of anticipatory bail subject to the condition that the petitioner shall strictly abide by the terms and conditions of compromise mentioned in the mediation report dated 22.12.2025.

Let the petitioner, above named, in the event of his arrest / surrender before the learned court below within a period of six weeks from today be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Complaint Case No. 882 of 2023 subject to the condition as laid down under Section 482(2) of the B.N.S.S.
