The petitioners apprehend their arrest in Suryagarha P.S. Case No. 59 of 2017 instituted for the offence under Sections 366(A)/34 of the Indian Penal Code.
As per written report, the sister of the informant Dropadi Kumari aged about 16 years went to call of nature, but she did not return. During course of searching, the informant learnt that Raushan Kumar along with these petitioners have kidnapped the sister of the informant.
The counsel for the petitioner has submitted that the girl has eloped with Raushan Kumar. The father of Raushan
Patna High Court Cr.Misc. No.29660 of 2017 (3) dt.03-08-2017 2/3 Kumar has also filed a case against the informant and others for abduction of his son vide Complaint Case No. 187C of 2017 for the offence under Sections 364/34 of the Indian Penal Code on 7.4.2017.
From the written report it appears that these petitioners are Fufa and Fua of Raushan Kumar. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today, in connection with Suryagarha P.S. Case No. 59 of 2017, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge 1st-cum-Special Judge, POCSO, Lakhisarai, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
