JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Special Case No. 10569 of 2018 arising out of Phulwari Sharif (Janipur) P.S. Case No. 911 of 2018 for the offenses under Sections 30(a) (b) (c ) of the Bihar Prohibition and Excise Act, 2016 Act. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Referring to the prosecution case he submits that three persons were named in the FIR and two, namely, Amit Singh and Tripurari Kumar Singh have been granted bail by the Co-ordinate Benches of this Court on 17.12.2018 and 18.12.2018 in Cr. Misc. Nos. 75530 and 75738 of 2018.

Considering the aforesaid, let the petitioner, above

Patna High Court Cr.Misc. No.80495 of 2018(2) dt.15-01-2019 2/2 named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise), Patna in connection with Special Case No. 10569 of 2018 arising out of Phulwari Sharif (Janipur) P.S.
