ANJANA MISHRA ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and learned counsels for the informant and the State.

The petitioner is apprehending his arrest in connection with Dariyapur P.S.Case No. 279 of 2014 registered under Sections 302/34 IPC and 27 of the Arms Act.

Earlier case diary in the present case was called for, which has since been received.

Learned counsel for the petitioner submits that the petitioner was not named in the FIR but subsequently has surfaced on account of the fact that the deceased had taken chow mein with one Dablu Rai and one person from village Dharmagat, who has covered his face with muffler. Learned counsel further submits that save and except the fact that a suspicion has been drawn

Patna High Court Cr.Misc. No.28902 of 2015 (4) dt.07-10-2015 against the petitioner as he had some altercation with the deceased during the course of a cricket match being played between them, it was suspected that the petitioner had a role to play in causing the death of the deceased.

Considering all the materials on the record and after hearing learned counsels for the informant and the State it appears that save and except the said suspicion there is no other further cogent material on the record so as to implicate the petitioner and that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest/surrender in the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Dariyapur P.S.Case No. 279 of 2014 to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
