JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-04-2019 The petitioner is aggrieved by the notice issued under the Bihar Public Land Encroachment Act. The Court is of the considered view that the writ petition at the stage of notice is premature and as such not sustainable. However,liberty shall be available to the petitioner to file his reply in response to the notice and the reply of the petitioner shall be considered by the respondent-authority. While taking decision the respondents have to see that the petitioner need not be vexed for the same cause time and again and they are required to take appropriate decision in accordance with law following the principles of natural justice. With the aforesaid, the writ petition stands disposed of.
