JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under section 366(A) of the Indian Penal Code.

It is alleged that the petitioner along with other accused persons kidnapped the daughter of the informant. It is submitted on behalf of the petitioner that victim in her statement under Section 164 Cr.P.C. stated that she voluntarily left her house out of her own sweet will and solemnized marriage with the petitioner. The petitioner has no criminal antecedent.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the Section 164 Cr.P.C. statement of the

Patna High Court CR. MISC. No.24187 of 2023(2) dt.27-06-2023 2/2 victim, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Pakaridayal P.S. Case No. 4 of 2019 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
