The petitioner apprehends her arrest in Nayagaon P.S. Case No. 69 of 2015, registered for the offences punishable under Sections 304(B), 201 and 34 of the Indian Penal Code. The informant alleged that his daughter was married with Ajit Rai in the year 2013 and after marriage, the accused persons started demanding Rs. 1,50,000/- and a motorcycle. On 28.07.2015, the informant got information on his mobile that his daughter was burnt to death.
Learned counsel for the petitioner submits that the petitioner is mother-in-law of the deceased. No allegation of demand of dowry and torture is made against the petitioner. The daughter of the informant died due to accidental fire while she was
Patna High Court Cr.Misc. No.29985 of 2016 (2) dt.08-09-2016 2/2 cooking food and she was under treatment in the hospital and ultimately she succumbed to injury.
Learned Additional P.P., however, opposed the prayer for anticipatory bail.
Considering the facts aforesaid and the fact that the petitioner is mother-in-law of the deceased and the informant has not made any allegation about demand of dowry and torture against the petitioner, the petitioner above named in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Nayagaon P.S. case No. 69 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
