The petitioner apprehends her arrest in a case registered for offences punishable under Sections 302/34 of the Indian Penal Code.
It is contended that it would be apparent from the order of the Sessions Judge rejecting the anticipatory bail of the petitioner that the allegation of assault does not stand corroborated by the inquest report or the post mortem report inasmuch as there is no external injury has been found upon the deceased though the allegation is that the petitioner had caught hold of her and her husband assaulted the deceased by the root of the bamboo. Patna High Court Cr.Misc. No.31260 of 2016 (2) dt.11-08-2016 2/2 urged that the petitioner is a lady and allegation of assault is upon her husband, who is already in custody.
Having regard to the facts and circumstances of the case, let the petitioner, namely, Punam Devi be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Karjan P.S. Case No. 37 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri A.K.Pandey, Judicial Magistrate, Birpur subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
