Petitioner seeks bail in Chakia P.S.Case No.345 of 2017 registered for the offences under Sections 386, 387, 1209(B) of the Indian Penal Code and Sections 25(1-b) a/26 of the Arms Act.

Allegation is of recovery of one loaded country made pistol and four live cartridges kept in the pocket of the pant of the petitioner.

It has been submitted on behalf of the learned counsel appearing for the petitioner that he has been falsely implicated in this case and nothing has been recovered from the possession of the petitioner. He has been arrested merely on the basis of suspicion. He is in custody since 30.12.2017. Considering the aforesaid facts and circumstances of

No.80439 of 2018(3) dt.13-03-2019 2/2 the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., East Champaran, Motihari, in Chakia P.S. Case No.345 of 2017 subject to the conditions that (I) bailors should be of local having sufficient immovable property lying within the jurisdiction of the court concerned. (ii) petitioner/s shall cooperate in the trial and shall be represented on each and every date fixed by the court. (iii) if the petitioner tampers with the evidence or the witnesses of the case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
