JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-07-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the petitioner and Shri Khurshid Alam, the learned counsel appearing for the State. At the outset, the learned counsel for the petitioner submits that the present writ petition be disposed of with liberty to the petitioner to approach the Circle Officer, Hulasganj Anchal in the district of Jehanabad for the purposes of filing appropriate petition for removal of encroachment over the

Patna High Court CWJC No.7136 of 2020(2) dt.09-07-2020 2/2 public land in question bearing Khata No. 102 and 33, Plot No. 341, 304 and 81 situated at Mauza- Mirjapur under Hulasganj Block in the district of Jehanabad.

Having regard to the limited prayer made by the learned counsel for the petitioner, the present writ petition stands disposed of with liberty to the petitioner to approach the Circle Officer, Hulasganj Anchal in the District of Jehanabad (Respondent No.5) by filing appropriate petition under the Bihar Public Land Encroachment Act, 1956 whereupon the respondent no.5 shall take appropriate action and dispose of the same in accordance with law expeditiously.
