Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323, 308, 354B, 379, 448, 427, 504, 506, 509, 34 of the Indian Penal Code. It is alleged that these petitioners along with other coaccused entered the house of the informant with bad intention. On halla, these petitioners are alleged to have fled away, taking household articles.

It is submitted on behalf of the petitioners that there is

Patna High Court CR. MISC. No.24218 of 2023(2) dt.27-06-2023 2/2 no allegation of assault against these petitioners. As a matter of fact, these petitioners used to place cow and buffalo in front place of the informant for which the altercation took place. Case and counter-case.

Learned counsel for the State vehemently opposed the prayer for pre-arrest bail.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Munger in connection with Sangrampur P.S. Case No. 305 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
